Conservation Commission Minutes 07/15/09
FINAL
Present for the Conservation Commission and attending the meeting were:  Richard Steves, Chairman, Pam Goff, Vice Chairman, Bruce Bartels, Dick Smith, Sandy Broyard, Virginia Dyer, Rusty Walton and Chuck Hodgkinson.  George Sourati also attended.  Caitlin Jones and Andrew Fischer were absent.

Mr. Steves opened the meeting at 12:30 PM.  The site visits for today’s meeting took place on July 14.

GEORGE SOURATI FOR JANE WACHSLER; SE 12 – 587; AP 26-1:  Mr. Steves opened the public hearing at 12:30 PM.  Mr. Sourati reviewed a revised site plan dated 7/15/09 to construct a single-family residence and install associated utilities including a new sewage disposal system, a well and water line, a driveway and underground electric service.  The house, decking and septic system will be outside the 100-foot buffer zones of several wetland areas.  The driveway, well, water line, three-foot wide walking trail and proposed fescue lawn area are within the 100-foot buffer zones of several wetlands.  The well is the closest activity to the wetland and is approximately 48 feet from the wetland edge.  The house and decking are approximately 135 feet from a riverfront area and within the 200-foot riverfront buffer zone.

Chuck H. reviewed the DEP comments on the application calling for the proposed house to be moved outside the first 100-foot riverfront zone.  He added that the DEP did not read the site plan accurately and in a subsequent conversation agreed the proposed location satisfies their request.  The Commission reviewed the Riverfront Act and determined the proposed activity meets the requirements for a lot created before 1997.  After discussion and with no comment from the audience, a motion was made to close the hearing at 12:45 PM.  The motion was seconded and unanimously approved.  A subsequent motion was made to approve the revised site plan as presented and dated 7/15/09 with the following special conditions:  1. The shaded area in light green as shown on the 7/15/09 site plan will be the limit of the disturbed area, lawn and walking path.  2.  Any change to this plan including but not limited to lawn expansion or pruning vegetation outside the disturbed area must be reviewed in advance by the Commission.  3.  The Conservation Officer has the right to inspect compliance with this Order as needed in the future.  4.  The setback distances of the structures, septic system and well must be met as shown on the site plan.  5.  Any construction debris shall be removed from the site daily or stored in a covered dumpster each day.  6.  There shall be no underground storage of fossil fuels.  7.  The standard conditions shall also apply.  The motion was seconded and unanimously approved.

FOLLOW UP DISCUSSION GEORGE SOURATI FOR STANLEY STARTZELL; SE 12 – 586; 40 LARSEN LANE; AP 27.1-33:  Chuck H. summarized that this Order was conditionally approved on July 1.  The Commission required a determination of the perennial stream’s status and distance from the activity before issuing the Order.          Mr. Walton distributed a thorough report of his assessment.  The closest activity is approximately 170 feet from the stream.  The Commission thanked Mr. Walton for his diligence and complete analysis.  A subsequent motion was made to accept the Conservation Officer’s report and issue the Order of Conditions as outlined.  The motion was seconded and approved with five in favor and one abstention (Ms. Goff).

ADMINISTRATION:  

The July 1 meeting minutes were reviewed.  A motion was made to approve the minutes as presented.  The motion was seconded and approved by consensus.

Merle Berger response letter; SE 12 – 564; AP 27-15.1, 15.2:  The letter of response to Mr. Berger’s letter and requests dated June 17, 2009 was reviewed, approved and signed.

Martha Cottle’s dock license application; SE 12 – 577; AP 24-188, 190:   The Commission reviewed the dock license plan from the Commonwealth and agreed it is the plan as approved and therefore, has no comments to offer.

With no further business to conduct the meeting adjourned at 1:10 PM.
